Legalization –

Our work concerning legalization involves, identifying and informing our clients of any potential requirements of the country to which you are delivering your documents. We have experience with a wide range of documents going to various countries and we are happy to guide you as to the standard procedure for any specific country.
Here is a short step by step guide to help you understand the requirements in different parts of the world, what steps are required and how we can help you overcome these obstacles.
There are three types of legalizing documents:

1- Simple Notary Legalization/No further process needed
In these Instances, having the notary’s signature and stamp on the documents is enough.

2- Apostille Required
Several countries require the document to be signed by a notary and then taken to the Ministry of Foreign Affairs to be stamped with an A5 sized certificate confirming that the person who is signing the document is considered an official notary in Bahrain.

3- Requires Consular Legalization
Where the document is going to a country which is not a signatory to the Apostille treaty, then the notarized document, shall get an apostille and then taken to the consulate of the country in which the document is to be used. The Consulate sole scope of work will be to confirm and verify the authenticity of the Apostille.

Declaration of indebtedness

Debt collection is a constant problem for businesses and individuals in the Kingdom of Bahrain. For many, the costs of pursuing a debt through the legal court system are excessive and the time commitment required often makes litigation a less than ideal choice.
Fortunately, the Bahraini legal system provides a faster and more cost-effective route for resolving debts that largely eliminates the necessity of pursuing debts via litigation.
Our experts can complete a declaration on behalf of the Debtors and Creditors of debt in writing and have it notarized in our office and stamp the document as writ of execution. Allowing the collection of debt without the burden of first completing extended legal proceedings.
Upon stamping by the notary, this declaration becomes an executive deed, and is actionable following a quick procedure at the appropriate Bahraini Court in accordance with Article 244 of Bahrain Civil & Commercial Procedures Act. Thus, the creditor saves time and money by avoiding time consuming application and filing fees. The amount in debt is then recovered by the creditor using the Bahraini Courts’ execution process, as if the writ is issued by a court following litigation.
Because this declaration requires cooperation between creditors and debtors, it’s best suited for situations where parties are beginning their commercial relationship or have agreed to a payment plan for existing debt. The declaration document should outline the terms of payment, including particulars concerning the amount itself as well as payment dates. Overall, this process gives the debtor flexibility, whilst the ability to convert the declaration into a writ of execution provides the creditor with security.
Generally, the steps to complete a declaration of debt for sealing as an execution writ by the notary is as follows:
1) Finalize a declaration of debt, which is usually drafted at our office upon the parties’ request
2) The debtor signs the declaration in front of the notary.

Power of Attorney

A Power of attorney is a legal document which allows you to appoint someone else (your ‘attorney’) to represent you and act on your behalf, including but not limited to the signing of legal documents. Many people appoint a relative or a friend as their attorney, who does not have to be a lawyer. You can specify the scope of the authority that you want to delegate to your attorney, which can be very wide, or restricted to specific transactions. Certain things are so personal they cannot be delegated to an attorney (e.g. signing your will or taking your driving test).
A power of attorney needs to be signed in front of a licensed notary like ourselves in order for it to be legally binding. We offer a free initial telephone consultation so feel free to call us on +973 17678758 or email us to arrange an appointment.
